I filed a small claims in March 2008 against Lionel Rockey, Susan Rockey and Lisa Arend, for illegal eviction, failure to comply with a court order, defamation of character, intentional infliction of emotional distress, making false reports and punitive damages cost of filing this action was 106.00. I paid extra to have Lisa Arend served by the sherriff as well as a third party to this claim and she didn’t show up for any of the three court dates, either and no warrant was ever issued for her failure to appear.br /> After the Defendants refused the service of this claim in March 2007 they were finally served by the sherriff. The Defendants were granted two continuances and we finally were given a trial date of June 24th 2009, for two hours.br /> Prior to our trial date; I ordered transcripts from Mary Ann Haugee in the amount of 65.00 for our November 2008 in which I agreed to try to mediate this out of court in which was terminated due to the lack of cooperation from the Defendants and we went on the record with Judge Julia Jent and she said a lot to the defendants while on the record.br /> When paying and receiving the transcripts a lot of what was said was left out of the transcripts.br /> I payed for transcripts that were incomplete. br /> I was there; I know what was said and the court reporter left a lot of information out that the judge said to the defendants. I asked for a refund or a complete set of transcripts and I received nothing and had no choice but, to proceed to trial without them.br /> I had approx. 50 pieces of documentation to enter into evidence in order to prove my case.br /> I had four 911 CDRom disks , from the City of Portage, casette tapes of Susan rockey( making threats of killing my mom), over 400.00 worth of transcripts, pictures, police reports, Incident reports and witnesses sitting in the hall ready to testify on my behalf, to prove my case.br /> I was not given an opportunity at all to present my case. I spent alot of time and money over the past two years preparing for this day; only to have this judge yell at me every time I tried to talk. The judge made it plain and clear to me me she is NOT reading anything; I tried and tried to be as calm and as collected as I could about this but, I couldn't understand why after working so hard in preparing this case for trial without an attorney and, what a good job I did with obtaining all this evidence. I prepared a chronology of events, having everything labeled by Exhibit #’s, made 3 copies of each; (one for me, one for the defendants and, one copy for the judge)br /> to be treated with such disrespect from the judge and not to mention her calling me names in November 2008 in which did not show up in the transcripts; I purchased.br /> I filed a motion with the courts and requested a cassette player be present in the court room so that my tapes could be heard. (Nothing provided)br /> I filed a motion with the courts and requested that a device be available to play the 911 CDRom disks obtained from the portage police Department. (Nothing provided)br /> br /> I was not allowed to enter ANYTHING into evidence; Not one piece of paper.!!!br /> The judge seemed to be so confused and, I don’t know why. She seemed to be very aggravated by the fact that her folder was not in order, at first. br /> Then, she seen the evidence that I had; that was very relevant to my proving my case and told my she’s not reading ANYTHING!!!!!br /> And me; being the plaintiff should of had an opportunity to present my case, and present evidence on my behalf, to prove my case and I wasn’t given that opportunity.br /> “This is NOT, justice”br /> My rights have been violated.br /> br /> br /> Judge Julia Jent failed to mention anything about the illegal eviction; I sued for.br /> She failed to recognize the fact that my personal belongings were withheld from me for two and ½ years after the eviction, with a court order. Also punitive damages should have been awarded for the illegal conviction and illegal conversion of property.br /> br /> Judge Julie Jent failed to cover my defamation allegation in which I could have proven if only I had been able to present my evidence.br /> br /> Judge Julie Jent failed to hear my allegations of false reports the Defendants made against me over the past 3 years. (15 False reports were made against me and, I am able to prove those as well).br /> br /> Judge Julie Jent failed to hear my illegal eviction in which I am able to prove by incident reports from the portage PD and transcripts.br /> br /> Judge Julie Jent failed to address my case of illegal conversion of property.br /> br /> After having a 2 hour trial set the Judge decides after 45 minutes and not entering any of my evidence into trial that she would be DISMISSING my case without prejudice getting up and walking out of the court room. br /> br /> I had the right to be heard and, I was not heard; therefor, I believe my rights were violated.br /> She was not patient, dignified or courteous to me and my case was not heard fairly.br /> Judge Jent did not devote adequate time to hearing one bit of evidence from me and my case was not disposed of efficiently and fairly.br /> br /> What about the 106.00; I just spent to serve these people and go to trial and being told by the judge that I am not reading ANYTHING???????????br /> What happened to my 2 hour trial? And why in the 45 minutes that we were in court; why was I not able to present ANY evidence?br /> br /> Is it because the Defendant retained councel who use to be a prosecutor/retired Judge in Porter Count?br /> br /> In Nov. 2008 the judge seen it the way it was but, when the Defenants appeared in court with a lawyereverything changed. br /> br /> I would request transcripts from this trial but, they’re gonna be incomplete.br /> You would think; you get what you pay for but, you don’t.br /> You get in transcripts what they want you to have.
